Terms of Use

These Terms of Use ("Terms") govern your use of scandere.cc and our application forms, which are operated by Scandere LLC, a New Mexico limited liability company ("Scandere", "we", "us"). By using the site or submitting an application, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and able to enter into a binding agreement to use the site or apply.

2. Our services

Scandere offers sales coaching, closer and setter recruitment, and CallReviewer, our call review software. The site describes these services for general information only. Any coaching program, placement or software subscription is governed by a separate written agreement, and that agreement controls if it conflicts with these Terms.

3. Applications

Submitting an application does not create a contract, and it doesn't guarantee acceptance, a call, a placement or access to any program. You agree that the information you submit is accurate and belongs to you. We may decline any application for any lawful reason.

4. No guarantee of results

Results in sales depend on your effort, skill, the offer you sell and market conditions. Any income, commission, close-rate or revenue figures mentioned by Scandere, including individual client results, are not typical and are not a promise or guarantee that you will achieve similar results. Placement is not guaranteed.

5. Relationships between closers and businesses

Unless a separate written agreement says otherwise, Scandere is not a party to any arrangement between a closer or setter and a business they work with. Scandere is not responsible for compensation, commissions, performance or conduct under those arrangements.

6. Intellectual property

The site and its content, including text, graphics, the Scandere name and logo, and the names and descriptions of our coaching protocols and programs, belong to Scandere or its licensors. You may view the site for your own personal, non-commercial use. You may not copy, republish or sell its content without our written permission.

7. Acceptable use

You agree not to submit false or automated applications, scrape or copy the site in bulk, interfere with its security or operation, or use it for any unlawful purpose.

8. Third-party services

The site uses and links to third-party services, such as Calendly for scheduling and Whop for our community. Their own terms and privacy policies apply, and we're not responsible for their content or practices.

9. Disclaimers

The site is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.

10. Limitation of liability

To the fullest extent permitted by law, Scandere will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the site. Our total liability for any claim relating to the site will not exceed one hundred US dollars ($100).

11. Governing law

These Terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-law rules. Any dispute relating to the site will be brought in the state or federal courts located in Bernalillo County, New Mexico.

12. Changes

We may update these Terms. When we do, we'll change the "Last updated" date above. Continuing to use the site after that means you accept the updated Terms.
